Event Waiver & Assumption of Risk

1. Scope of This Agreement

This Waiver and Assumption of Risk ("Agreement") applies to all participants in events organized, hosted, or facilitated by Agapé ("Agapé," "we," "us," or "our"), including but not limited to social gatherings, sporting events, outdoor activities, transportation, and food-related events held in the Dallas–Fort Worth area and surrounding regions.

2. Assumption of Risk

I understand and acknowledge that participation in Agapé events — including, without limitation, paintball, skating, ATV activities, sports, physical games, and transportation to and from events — involves inherent risks of injury, illness, property damage, or death. These risks may result from:

• Physical contact or collision with other participants or objects
• Slips, falls, or trips on event premises
• Equipment malfunction or misuse
• Weather or environmental conditions
• Transportation to, from, or during events
• Food allergies or dietary reactions
• Actions of other participants or third parties
• My own physical condition or pre-existing health issues

I voluntarily assume all such risks, known and unknown, and accept full responsibility for any injury, loss, or damage that may occur.

3. Release of Liability

To the fullest extent permitted by applicable law, I hereby release, waive, discharge, and covenant not to sue Agapé, its organizers, volunteers, staff, partners, and venue operators (collectively, "Released Parties") from any and all claims, demands, losses, damages, costs, or expenses arising out of or related to my participation in any Agapé event, whether caused by the negligence of the Released Parties or otherwise.

4. Indemnification

I agree to indemnify and hold harmless the Released Parties from any claims, damages, or expenses (including reasonable attorneys' fees) arising from my participation in any Agapé event or my breach of this Agreement.

5. Medical Authorization

In the event of an emergency in which I am unable to make decisions for myself, I authorize Agapé representatives to seek and consent to emergency medical treatment on my behalf. I understand that Agapé is not responsible for any medical costs incurred.

6. Food & Dietary Allergies

Agapé events may involve food and beverages. I acknowledge that Agapé cannot guarantee an allergen-free environment and that I am solely responsible for managing any dietary restrictions or food allergies. I am encouraged to notify event organizers of any severe allergies prior to attending.

7. Transportation

If transportation is arranged or coordinated in connection with an Agapé event, I acknowledge that Agapé is not a licensed transportation provider and assumes no liability for incidents occurring during transit. I participate in any group transportation voluntarily and at my own risk.

8. Minors

Agapé events are generally intended for adults 18 years of age and older. If a minor is permitted to attend with prior written consent from a parent or legal guardian, the parent or guardian assumes all risks and responsibilities on the minor's behalf and agrees to this Agreement in full.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under this Agreement shall be resolved exclusively in the courts of Dallas County, Texas.

10. Severability

If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.

11. Acknowledgment

By submitting an RSVP for a designated higher-risk event, or by attending any Agapé event, I confirm that I have read, understood, and agree to this Waiver and Assumption of Risk in its entirety. I am at least 18 years of age, of sound mind, and signing this Agreement freely and voluntarily.
